Abstract The trademark law in India enables innovators to have exclusive rights over their products or service by providing them a unique identity. According to Section 2(1)(zb) of the Trademarks Act, 1999, defines a trademark as a mark that is described as the capable of being represented as graphically to identify and distinguish the goods and services of a particular owner from others. The trademark provides exclusive rights and various advantages to its owners such as an increase in the sales, advertisement of the product or service, establishing the reputation of the product or service, etc
