From Privacy to Publicity : The Development of Personality Rights in India

Abstract Over the last few decades in India, as in other parts of the world too, there has been significant movement towards codifying laws regarding the recognition of personality rights. This paper examines the development, current legal frameworks, and emerging challenges concerning personality rights in the context of IPR within India. The study especially seeks out how the protection of personality as an IP right co-exists with its commercialisation. The paper also examines the effects of new advancements in technologies on these legal rights and their enforcement. The results highlight how such an IP Law needs also to consider the marketing aspects of such an IP, which will help in maintaining the priorities of these IP laws on a global level.
