Abstract | This position paper examines the evolving legal framework of guardianships for people with disabilities in India, with a focus on the National Trust Act, 1999. It analyzes the historical, legal, and societal contexts shaping disability rights and evaluates the Act’s provisions against international standards such as the UNCRPD. The paper highlights the successes, challenges, and regional disparities in implementing guardianships, particularly through Local Level Committees (LLCs). It also explores global best practices and recommends integrating technology, enhancing inclusivity, and adopting supported decision-making models to strengthen guardianship mechanisms. The paper underscores the necessity of dynamic legislative reform to address contemporary mental health advancements and disability needs, ensuring a comprehensive and equitable approach to guardianships. |
