Judicial Review in India: Harmonizing Constitutional Authority with Democratic Governance

Abstract The doctrine of judicial review is a cornerstone of democratic governance. It first flourished in the USA and was brilliantly articulated in the landmark case of Marbury v. Madison (1803) by John Marshall, the esteemed Chief Justice of the American Supreme Court. In India, the power of judicial review is not just an authority but a sacred trust bestowed upon the judiciary by the Constitution itself, encompassing both the Supreme Court and High Courts.
