Judicial Doctrines and India's Federalism

Abstract This essay explores the complex mechanisms of India's federalism, a system that distributes authority between the federal government and its component states. The Seventh Schedule, which assigns legislative authority to the Union and the states, lays out the federal framework established by the Indian Constitution. However, preserving the balance of power between the two tiers of government depends heavily on the judiciary's interpretation and application of legal principles like geographical linkage (Territorial nexus), colourable law, and pith and substance.
