Affirmative Action and Meritocracy in India: A Detailed Analysis of the National Commission for Backward Classes (NCBC)

Author(s) Kashish Avinash Shah
Country India
Abstract This paper revisits the evolving concept of justice in contemporary India by examining key judicial trends and constitutional mandates. It delves into how the Indian judiciary, particularly the Supreme Court, has played a pivotal role in redefining justice through progressive interpretations and landmark judgments. The research underscores the transformation from a formalistic understanding of justice to one that embraces substantive equality, social welfare, and human dignity. It also highlights how judicial activism, public interest litigation, and the doctrine of constitutional morality have influenced the delivery of justice. Ultimately, the paper offers a nuanced analysis of whether the judiciary has managed to uphold its constitutional promise of justice—social, economic, and political—for all.
