Abstract A malicious prosecution is the malicious institution of unsuccessful criminal or liquidation proceedings against another without reasonable or probable cause. It is an abuse of process of the court by wrongfully setting the law in motion on a criminal charge. In this article, the researchers discuss the essential ingredients of malicious prosecution. This article not only covers criminal prosecutions but also the civil process. Further, the paper analyses several cases of the Supreme Court and High Courts.
